Who this is between
“We” and “Up Nextd” means Up Nextd, based in Dubai, United Arab Emirates, reachable at contact@upnextd.com. “You” means the business that creates an account — a salon, a clinic, a studio — and the person who creates it on the business’s behalf. By creating an account you agree to these terms and to our privacy policy.
These terms are for businesses. Your customers do not sign up to anything: what Up Nextd keeps about them, and their rights, are in the privacy policy and on the privacy page every waitlist has.
What the service is
Up Nextd keeps a waitlist for your business. Customers add themselves through a link you share; when an appointment opens up, Up Nextd tells you who should be offered it and drafts the WhatsApp message. You send it, from your own WhatsApp. Nothing is sent to a customer unless you send it. The countdown, the “next person” and the revenue figures on your dashboard are there to help you decide; the decisions are yours.
We are building an assistant that will send offers and read replies for you. When it exists it will be a separate, clearly-labelled plan, and it will never send anything you have not turned on.
Your account
- You need to be at least 18 and entitled to act for the business you set up.
- Keep your password to yourself. Anything done with your account is treated as done by you, so tell us straight away if you think someone else has it.
- One account runs one business. If you have a second location or a second business, it gets its own.
- The details you give — your business name, services, prices, logo — must be yours to use and accurate enough that a customer is not misled.
Your customers, and their details
The people on your waitlist are your customers, not ours. You are responsible for having the right to contact them: they gave you their number to hear about openings, and that is the only thing the list is for. In particular:
- Only message people about openings they asked about. No promotions, no unrelated offers, nothing to someone who asked to be taken off the list.
- When a customer asks to be removed, remove them. The privacy page on your waitlist tells them to ask you first.
- Messages go out through your WhatsApp account, so WhatsApp’s own terms apply to them, and to you.
- We hold the list on your behalf and use it for nothing else. What we keep, where, and for how long is set out in the privacy policy, which is part of these terms.
What it costs
Your first month is free. After that, Up Nextd costs AED 149 per month, per location, or AED 1,490 per year, excluding VAT. Businesses that join during the pilot pay AED 99 per month, fixed for their first 12 months.
- Everything is included. There are no per-message fees and no commission on the appointments you fill.
- We will tell you before the free month ends and before anything is charged. If we ever change the price, you will hear from us at least 30 days before it applies to you.
- You can cancel at any time. A monthly plan ends at the end of the month you have paid for; we do not refund part-months. An annual plan is refunded for the whole months you have not used.
- If a payment fails, we will ask you to fix it. After 14 days without payment we may pause your account until it is.
What we promise, and what we don’t
We work hard to keep Up Nextd available and correct, and we fix problems quickly. But it is software, and a young product:
- We do not promise that any particular slot will be filled, or that a customer will reply. The waitlist gives you a better chance; it cannot make anyone turn up.
- We do not promise the service will never be interrupted. Planned maintenance and the occasional fault happen; we will keep them short and tell you when they matter.
- Up Nextd is not a booking system and does not replace yours. It does not know about appointments you did not enter.
- Our liability to you for anything arising from these terms is limited to the fees you paid us in the three months before the claim. We are not liable for lost profits or indirect losses — a slot that stayed empty, a customer who did not come. Nothing here limits liability that the law does not let us limit.
What you must not do
- Add people to a waitlist who did not ask to be on it, or use it to send marketing.
- Use Up Nextd for anything unlawful, or in a way that breaks WhatsApp’s terms.
- Try to get at another business’s data, overload the service, or work around its limits.
- Resell access, or share one account between businesses.
If you do, we may suspend or close your account. We will tell you why, and give you a chance to put it right unless the harm is serious or ongoing.
Ending things
You can close your account whenever you like by asking us at contact@upnextd.com. We delete the account and everything in it — your business, your waitlist, your customers’ details — which is what we promise your customers on the privacy page. We may end the service by giving you 30 days’ notice; if we do, we refund any period you have paid for beyond that date.
Changes to these terms
We will change these terms as the product grows — the assistant will need a section of its own. When a change matters to you, we will email the address on your account at least 14 days before it applies. Continuing to use Up Nextd after that is accepting the change; if you do not accept it, you can close your account before it takes effect.
Law and disputes
These terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, and any dispute goes to the courts of Dubai. Before it gets that far, write to us — most things are a misunderstanding, and we would rather fix it.
